Xplor Party Bus

Liability Waiver

Please read this form carefully and be aware that by signing a contract for yourself or your minor child or on behalf of another person/rider in  your group for use of vehicle/boat owned or operated by Xplor (Alcoholegio) Party Bus LLC, you are waiving and releasing all claims for injuries you or  your minor child or passenger riding with you may sustain arising out of its rental/use.  

I recognize and acknowledge that there are certain risks of physical injury involved in on roads, or open waters, and I agree to assume the full risk  of any injuries, including death, damages, or loss, regardless of severity, which I or my minor child, or any of my passengers may sustain as a result  of participating in the rental/use of an Xplor (Alcoholegio) Party Bus vehicle/boat.  

I agree to waive and relinquish all claims my minor/child, myself or any passenger that rides with me may have against Xplor (Alcoholegio)Party Bus and  its officers, agents, servants, and employees as a result of renting or using Xplor (Alcoholegio) Party Bus vehicle/boat. 

I do hereby fully release and discharge Xplor (Alcoholegio) Party Bus and its officers, agents, servants, and employees from any and all claims from injuries,  including death, damage or loss, which may occur to me, my minor child, or any of my passengers and arising out of, connected with, or in any way  associated with activities involved in renting/using Xplor (Alcoholegio) Party Bus rental vehicle/boat.  

I further agree to indemnify and hold harmless and defend Xplor (Alcoholegio) Party Bus and its officers, agents, servants, and employees from all claims  resulting from injuries, including death, damages, and losses, sustained by me, my minor child, or any of my passengers arising out of, connected  with, or in any way associated with the activities involved in renting/using an Xplor (Alcoholegio) Party Bus vehicle/boat.  

Person signing the contract assumes all legal responsibility and is in charge of informing all passengers and signing waiver for any minors aboard any Xplor (Alcoholegio) Party Bus vehicle/boat. 

Express assumption of risk, complete waiver, and agreement to sue, and indemnity agreement. In return for the license to use Xplor (Alcoholegio) Party  Bus vehicles including but not limited to buses, boats, facilities as well as any other persons or entity related thereto and/or its subsidiaries and  affiliates (operators/drivers/captains) the undersigned (participants/customers/passengers) for themselves, their heirs, assigns and legal representatives, hereby expressly agree: 

To assume all risks involved in or arising from participants’ use or presence upon the facilities or vehicles/buses/watercrafts including, without  limitations, the risks of death, bodily injury, or property damage resulting from: collision, inside or outside the vehicles/watercrafts.  

To release operator, franchisers and all successors, assigns, subsidiaries, branches, operators, franchisees, affiliates, officers, directors, employees, sellers, suppliers, manufacturers, agents, vendors, contractors, tenants, landlords, and sponsors form, and not to sue them on  account of or in connection with, any claims, causes of action, injuries, damages, costs, or expenses arising out of participants’ use of or  presence upon the facilities/vehicles/watercrafts, whether or not caused by the negligence or other faults of operator including strict  product liability or any other liability or any other liability without fault. 

To release operator, and other parties identified in paragraph 2 and owners of the facilities (owners) of any and all responsibility to participants and agrees to indemnify and hold harmless operators and owners against any and all damages or injuries arising out of the use of  the facilities/vehicles/watercrafts by any party including other participants that you have invited with your party/group. 

To indemnify and defend operator, against and hold harmless from any and all claims, causes of action, damages, judgements, costs, or expenses, including attorney fees, which in any way arise from participants’ use or presence open the facilities/vehicles/watercrafts. 

To pay for any and all damages to the facilities caused by participants, negligently, willfully, accidentally, or otherwise.  

That by participating in or utilization of the facilities/vehicles/watercrafts, I acknowledge that I fully understand the significant inherent dangers of being on/aboard/or near vehicles/watercrafts. I further acknowledge that I will read and comply with the safety rules provided to  me in writing or by verbal communication.
